We all have rights when it comes to promised shipping dates and notification of delays, the FTC spells it out explicitly that you must consent to keeping an order if its original shipping date is exceeded. It's a good thing for anyone to know when ordering online or over the phone.

Actually, the bank card I used to place the order was canceled long before they charged it. According to my bank, it's against regulations to put a hold on a charge longer than 30 days. That's why my bank canceled the hold. They're working to resolve the issue of how JeepAddOns was able to force the charge through. Probably the bank's fault for that one.

Clever use of quotations, by the way. Picking and choosing has never been to my taste. The point of my post is to make others aware of a potentially repetitive situation.

Thank you very much for the link! I've been reading through and it looks like there's also a provision for 50 day shipping holds. I'm well beyond that, as well, but it's something to take into consideration.

i wouldnt not order one. just like everything else check stock on hand before ordering. if there backordered get an estimated date and if you change your mind dont forget you ordered it.

I'll address a couple of points.

I emailed the customer once I learned of the situation. I never received a response from him.

Customer never called to cancel. We do NOT charge before we ship a product. We simply obtain an authorization at the time of the order and once we receive a shipping notice, the item is charged for. We don't "force" anything through banks. We simply send the charge and they process it. This way you know you're going to receive your product because we have the financial incentive to fulfill.

Customer received a NO CHARGE upgrade due to the backorder taking longer than expected. This was done with no communication from the customer complaining or anything. It was a gesture done to *everyone* who had one on backorder that was shipped after expected shipment dates. When we relay to customers information, we're not just making things up. If we don't have the inventory on hand for delivery, we provide the best information that we can based on manufacturer estimates.

Customers were told that the manufacturer originally expected the winches to come to port around the 21st of November and technically should ship out hopefully the week of the 28th. Since the winch went out on Dec 28, I guess that "technically" is within 30 days since van_Niets wants to throw FTC stuff in there. Of course when a container comes to port it has to pass through customs and be delivered. There were obviously delays in that date and the manufacturer and we as a retailer were doing everything we could to get them as quickly as we possibly could. As a matter of fact, the head folks at Engo worked through Christmas Eve and Christmas Day instead of spending it with their families getting products ready to ship. It's not like we're just sitting on the winches and holding out on them with an evil laugh. We don't get paid until we ship. Manufacturer doesn't get paid until they ship.

And this certainly isn't unique to us. Any retailer that resells Engo winches had customers that unfortunately had to deal with this delay. It sucks for the guy wanting a winch and it sucks for the retailers that are taking calls every day from people asking when they're going to ship and we feel awful when we give information that turns out unfulfilled. We give the best information available at the time, but obviously we are the ones that look bad if that information turns out wrong.

Bottom line is that you ordered a winch that took longer than expected. For that I apologize. We never received a notice to cancel the order and when winches were available, not only did we ship immediately but also upgraded your order to an upgraded winch at no additional charge like was done for many customers that were on backorder. You have an RGA number that was sent to you to return the winch if you wish, however because you never canceled the order you are responsible for restocking and shipping.

I will thank you for spreading the word through your many forums to those that truly read into what happened that we're good folks here at the company that fulfill orders that have not been canceled and offer free upgrades to those that don't even complain!

I ordered my 10k winch the last week of Dec, and then found out all the ones that came in went to previous backorders and mine would be on the next shipment. I was a little irked, but understood. My company orders parts from China and I know how long it take to get here. I now have a ship date of the 28th and look forward to installing the winch once it gets here.

My winch was waiting for me when I got home yesterday. I was surprised that it was not grey but had a carbon fiber (printed) wrap. The only pictures I had seen were grey up till then. I think I like the wrap better. Everything looked great.

It's actually called hydrographics, immersion printing, hydro dipping, etc. Then a hardened layer is sprayed over top of it to give it additional protection.

Pretty sweet eh?
