Looking to buy. Couple issues, need advice.

I'll start off by saying I'm a Jeep newbie. I'm currently looking at an '06 Wrangler 65th anniversary edition that has 35,000 miles. The interior/exterior look great aside from a few dings on the hood (hail?) that could be fixed.

I need advice on a couple issues.
1. It has had a leaking rear axle seal that has been replaced. What would cause this on a Jeep with 30k miles? Is this a big deal?
2. It has a creaking clutch that I didn't notice the first time I drove it. It sounds like it's coming from the transmission.

If the dealer fixes these issues, should I buy it? Is $16,500 too steep?
