Third brake light?

I was thinking about taking it off because my spare tire is flat. Is it illegal to take it off? Here is a picture

With a plug.

Or you buy a new spare.

And yes, if you are keeping it on the road, it's illegal to take off.

If you have insurance, your jeep was insured with--3 brake lights !!!

I suggest you keep 3, in whatever form !!

Some states only require 2...but if you don't know the laws for sure, I'd err on the side of caution and keep it.

Also, if your only reason is because your spare has a flat, then as mentioned above...fix it. That spare is there for a reason. To get you home when one of your non-spares has a flat.

If it's a small hole, a plug kit will cost around $5-10...and it's cake to plug a tire (unless it's a backhoe tire...then you'll need a plug kit and a BFH...lol). Or if you go to a local tire shop, many of them will patch it on the inside for like $25. Patching is good because there's less likelihood of the plug being thrown or leaking when it dries out...which seems to be a common issue I run into at work...plugs get worn out and begin leaking again requiring me to pull the plug and insert a new one.

Unless it's a hole in the sidewall, then it can't be fixed

If you have a buddy that works in a tire shop/gas station/---

He might fix a sidewall without a record and you'll agree to use it OFF-ROAD ONLY

Now that don't happen to often, but I've done it, (years ago) and I've had it done once here in Ca.

because when you call in to progressive they ask if your jeep has a the 3rd brake light installed....I've run mine for a little over a year without any problems

As noted, it's a state by state thing. Here in PA, if it came with it, you need to have it to pass inspection.
