You may want to check the side levers and make sure that they are engaging fully, and disengaging when released.Also if something is preventing it from locking when in the sitting position. Could be a seat cover, or just a sticking mechanism, or something under the seat putting pressure on the cables/ Just give it a good look over and it might be an obvious find.
Does it do this when empty, or only when someone is sitting in it?
Then I would think it is not latching correctly, or something is worn. Either way, a visual inspection should make it apparent. Good luck.
