I intentionally sought out a 2016 Rubicon Hard Rock with automatic tranny and the $695.00 4.10 gear upgrade. It clearly states on my window sticker that I have "Add 4.10 Axle Ratio" $695.00. However when I pulled the gears to install 4.88's I found I was running a 3.73 axle ratio. This means I was charged $695.00 for something I did not receive. I intend to take the gears to the dealership tomorrow to show them what came off the Jeep and demand my $695.00 refund. I do not know if someone screwed up at the factory or what happened but my Jeep definitely did not have the gears advertised and what I paid for.
I had read that 4.10's were fine with 35's. However I found that not to be the case. I kept downshifting on slight inclines at 70mph so I opted for 4.88's. Now that I know I was never running 4.10s they might have been sufficient to make the difference at highway speeds and I might not have needed to replace the gears. Of course now that the 35's are sitting under a metal cloak 3.5" game changer lift and PS Crusher flares, they look too small and 37's are now the next obvious step.

My Procal has dip switches so I have no idea what was programmed at first.
Determining gear ratio is as simple as counting the teeth on the ring gear and on the pinion and doing the math to see how many times the pinion gear rotates 360 degrees to move the ring gear 1 complete revolution.
You can do the same thing by jacking your jeep up and counting the number of times the driveshaft turns to rotate the tires 360 degrees.
There was another thread very recently about someone else complaining about the exact same thing. Is the axle housing marked? They sometimes have a metal tag or stamp indicating the ratio.
Yes, that build sheet is worth $695. Without the build sheet or if it had also said 4.10 gears, there would have been no way to prove to FCA that the gears he has in the box actually came out of his vehicle.

He ordered 4.10s. If he had got 4.10s he'd likely be happy..... BUT since Jeep gave him 3.73s he's a bit dissatisfied. KNOWING his Jeep had 4.10s he made the logical assumption he had under estimated how good 4.10s would be and installed 4.88s.

My guess is the dealership is going to tell you that 3.73 is what they ship with an automatic transmission, 4.10 would be what you'd get with a stick. It doesn't explain the difference between what your sticker said and your VIN, but that's still my guess.
My guess is his window sticker is not the original factory one, but a different one that the dealer prints up and replaces it with. That's fairly common. The dealer either made a mistake or tried to defraud a customer.
A dealer would not modify or replace the original sticker if they want to keep their dealership. Any mofications to or additions to the vehicle must be detailed on a side sticker. Those started showing up about 20 years ago. In fact I bought a Dodge P/U once with leather interior. During the negotiations, I asked how they could apply fabric protections to a leather interior. They claimed it was on the carpets. They wound up taking it off.
If a dealer adds pin striping, after market wheels and tires, or lift those are added there.
Vin number is on the window sticker there are fed laws regarding window stickers so a dealer is not going to print a fake one. This was a fudge from the factory.

Good they're going to stick up for you. That said, I think you have a good case to get them to reimburse you for the gears you bought (assuming you can't return). If they're willing to work with you, maybe they'll reimburse the cost and take them to use/sell with another customer?
If you're willing to burn some bridges, I'd bet you could get the cost of the new gears covered in small claims court. You'd represent yourself, the fee to file the case is about $50, and you'd get paid back (assuming you win) the cost of gears + court fees + whatever other $ you wanted to ask for. So long as the $ is less than $1-2k, most companies will settle after you file or agree before you file, since attorneys on their end will cost more than defending the lawsuit.
Also look up Deceptive Trade Practices laws for your state. Often that's an automatic 3x damages, in which case your threat to sue would net you quite a bit more than your original cost.
The point here isn't to make money, it's to get you back the money you unfairly lost or spent due to their mistakes/fraud/whatever-it-was.
Something like this really makes you wonder if there is a systemic issue at Jeep (i.e. warrants a class-action) or if you were a super unlucky one-off. The average person isn't going to know by the seat of their pants if they got the gears they paid for. It wouldn't be until a gear swap like this that someone would catch it.

In this case there is nothing to suggest legal action. And I would not call this a "one of". There are thousands of examples of manufacturers correcting mistakes. None of the corrections have happened at GM... or VW... or Firestone... but everyone else steps up to the plate.
Mistakes happen on the time on the assembly lines. It's how you get a Chevy Silverado with Chevy emblems on one side and GMC emblems on the other side. It's how you get a Rubicon with Rubicon hood stickers on one side and nothing on the other side. The key, is how the manufacturer makes them right.
happened with rams, were supposed to have 3.92 gears, all came through with 3.21. forget exact details, but chrysler was forced to make it right by a class action lawsuit.
Rubicons with a manual come stock with 4.10s that is their only option. Autos have the gear choice. Recheck your paperwork you should not have had to pay for that.
Probably going to less pain to take some Mopar Accessories than getting a refund. Just know that getting money back from a dealer is like blood from a stone. Might be quicker to ask for something of comparable costs in exchange. And not oil changes! Pick up some Mopar LED headlights or something that you want...
So yeah, that's not cool.
I'm really interested in seeing how they handle this. The pessimist in me says they'll try to tell you those gears could have come out of any Jeep, and there is now no proof your Jeep came with the incorrect gearing. This is purely hindsight talking, but I would have closed the diffs back up and taken it right to the dealer before doing the gear swap.
I imagine if there's a discrepancy between the build sheet and the window sticker, that problem will be easily solved. But if the wrong gears were put in at the factory and both sheets read 4.10 gears, that's where it will get tricky in your particular case.
dealer bought the jeep from fca and then marked it up a bit and sold it to him
so realistically both the dealer and him got screwed
