Rear seat coming out of the brackets?

Is it just me or do others have this problem too
When the rear seat is in the up position it can slide either way and come out of the holding brackets?
I found this out after making a rope to replace the missing strap that holds the seat in the up position, so what I did is I took a 2" dia flat washer and welded a spacer tube to it, painted it and installed it on the rod that goes into the hole, now when I strap the rear seat up it doesn't move off the brackets at all
Hardest part was finding a steel tube small enough to barely clear the shaft But I built teh whole thing for about $1.50

do you have the 2 wire retaining clips on the bar?(1 on each side-in the groove(on the bar)to the inside of the bracket?) if you are missing 1 or both it can slide out.
Mine came with a bunji cord hanging on the soft top clips on the roll bar-just streach it across and it holds the seat upright

ryan I just uped a pic onto imag shack
This is what I made

Uploaded with ImageShack.us

Sorry the quality is so bad, but you get the idea

Robbiecc, no there is no clip on either side, and I never knew there were supposed to be clips on there or else instead of making the part I would have got the clip box out and found two and saved the 3" or flux wire

There is supposed to be a wire spring clip that holds it from sliding out to the side.

Looks like this...

So Jerry if I take out my working spacer and install a set of those do I have to pull one to get the seat out? Cause with mine all I have to do is raise the seat and slide it to the passenger side. In the down position is stays in one place cause it locks when the back is put up.
