You are missing the 3rd brake light hardware. On the tub and the tailgate. Contacts where they meet make your 3rd brake light work.

Thanks guys. I have a bracket that I took off the tailgate cause it didn't look right, I also am missing the plastic cover trim; so it looks like the contacts on the tub side had two wires which I think we're cut off for an ORO spare license mount I'm doing away with.

Is there any kind of stop on the gate to prevent it from swing all the way open and hitting brake light?

My tailgate is pretty beat up. The PO had the 33x12.5-15" BFG AT spare mounted on the stock carrier without any bumpstops, when I purchased the Jeep it was missing one of the carrier mounting bolts. I have removed the spare, removed the carrier, straightened the sheet metal out as best I could and loosened all the hinge bolts to readjust everything and square it up. I tightened everything down and the gate closes properly now, I also added spacers on the lug nuts to move the tire away from the bumper so it sits square and made some bump stops to wedge between the gate and tire, definitely better than it was.
