Hey everyone. I know that its a fairly common occurrence on jeep wranglers for people to fold out their windshield wipers and then open their hood into them, thus scratching the hood. If anyone has any pictures of what these scratches look like, could you please post them? The more the better - I need them for a small claims case that has been filed against me. Even better would be a short video that shows how this happens. Thanks so much!
IMO the OP is doing the correct things to defend himself.
If he can prove the scratches on the plaintiffs vehicle are the result of opening the hood while the wipers are extended and then follows that up with documentation that shows the service he provided does not involve touching the wipers and/or opening the hood he has made a good defense of the allegations against him.
While it is true that the burden of proof lies with the plaintiff it's good to have evidence that while the vehicle was in the OP's possession there was no reason for him to have touched the wipers and hood. That in turn makes the burden of proof even more difficult for the plaintiff.
OK.. I agree with that. If needed, show and tell.. you only get one shot in court.
Just be a little more creative.. simply ask the judge to go out to the Jeep in question and demostrate for themselves by pulling the wipers out and see how they can contact the hood.
I admit I did this while washing my jeep had one wiper up still from cleaning the windshield and lifted the hood to wax under the edges. Put about 1 inch scratch on the hood. First scratch at 4,000 miles. At least the first one is over with lol:banghead:
