I took a look at them, I cannot tell if they are under copyright protection so I think it may be illegal to distribute without prior approval from the publisher.

A concerning matter indeed. Though no mention of distribution rights in the stuff I have, nor copyright. And the vendor had no mention of it either.
Just running through all the listings on ebay, and not one of them have anything mentioned about distribution, and those are for sale.
I should imagine the intellectual property rights of the manual belong to Chrysler/Jeep, in which case we're all Jeep owners ....

Seriously though, if they were in breach of copyright then they wouldn't be allowed to sell them on ebay. That's my take on it, but feel free to share knowledge if you know 100% to the contrary.

Otherwise, help yourself....

You can buy a book from Barnes and Noble, yet the publisher still holds copyright. Plus who is to say that the ebay seller is not distributing them illegally. My guess is that they are. Just because the copyright is not visible it is still implied.

Just like photos, the photographer holds the copyright on those pictures even without adding a copyright mark or statement.

They sell a lot of things on eBay that are illegal.

That is true, and if the mods take it down then that`s fine. If I'm wrong, I'm wrong and I'm not above holding my hands up.

Just looking at the jeep.com website for some answers, as this is bugging me.
It appears they're happy to serve up 04-present manuals of all vehicles for absolutely nothing.... including the 04/05/06 wrangler. So part of it's legal at least
But anything prior to 04 you have to pay for... IP rights are owned by Chrysler group LLC. Hmm, time to email Jeep....

Well I had a bee in my bonnet, so I called Jeep directly. I put this as many ways as I could, and I'm sure the guy thought I was retarded, but it's a valid question over copyright. His response:
Jeep have made the material available for public access and therefore has no issue with the distribution of it's service/repair manuals. I also had them follow this up with an email stating such to cover my @ss and yours. I explained the situation, jeep forum etc and they have no problem with it. I did mention ebay, to which he said there's nothing they can do about it as the information is in the public domain.

Did they say anything about someone selling the digital material for profit?

I think they would not like someone selling something they distribute for free.

The file in question contains copywrite protected documents. Free distribution of these documents is copywrite infringement and is not legal. The link has been removed and may NOT be reposted. A download link may be posted for any Jeep factory service manual for 2004 and newer jeeps which is available at the Jeep website.
