Driving home from work last Thursday, a lady not paying attention coming from the other direction, likely speeding, came into my lane around a corner and stuck my front tire first, then came down the side of the jeep and lastly into the new 8.8. The damage is really bad, bent frame tweaked tub. The front control arm mounts ripped from the axle. Both driveshafts are in two the new JB conversions SYE snapped in half along with the rest of the transfer case. The rear 8.8 with artec truss is bent. The upper control arm bolt sheared in half and then lower bolt ripped through the bracket on the frame side. My back is still sore but getting better. I have been told by the doc. It is just muscle soreness. I start physical therapy next week. My question is what's the best way to get enough money to replace my jeep. The jeep have a little over 200k on it however everything but the transmission and the transfer case were not original. I have only had the jeep a year and a couple months. I have over 10k in receipts. I know it's going to be hard to get enough to replace the jeep and bring the new one up to the specs of this one.
Another view. The lady that hit me did this damage in a Honda CRV. Her car ended up about 500 ft. Down the road I spin around twice and only went about 50 feet from original impact somehow not flipping over( I spun twice, once on the road once going through the ditch) at the time of impact my jeep was facing the opposite direction.
Sounds like the Jeep is totaled. You may have to fight (with receipts in hand) to get what you deserve for the totaled Jeep. Strip everything aftermarket off it if you can. Be glad that you are relatively unharmed and go shopping for a Jeep to replace the one you just lost. Man, it sucks losing a Jeep bc of someone else's poor driving.
Good luck in finding another Jeep that you want to buy.
Definitely go see a doctor. You probably have injuries you do not realize you have. Start collecting receipts and possibly look into an attorney to help you with everything. The vehicle side of it will be handled relatively quickly. However you want to wait to settle any medical side of it until you are sure the injuries have either been healed or mitigated with time and therapy.
Agree. I was hit by a big ass Ford 750 work truck...was sore for a while, didn't go away, saw the doctor.....had an MRI that showed 2 herniated discs in my mid back.....good thing I didn't just chalk it up " being a little sore".
Don't sign any papers until you know you are ok. Unfortunately, you are screwed. The insurance will probably only pay you KBB value unmodified. What's so bad, you were not at fault.
The main thing is that you are ok. Everything else can be replaced!
The insurance company will be calling, almost on a daily basis to ask if you're OK. Not that they care, they want to get you to say you're OK so they can close the books on possible injury claims. Let them know exactly how you feel, and see a doctor if you need to.
If there were any witnesses present that saw what went down make sure you have their contact numbers.
Sucks man, hope you recover fully!! Ditto all previous comments. I see this regularly in my business. People think it's minor, then months later it turns up a serious injury. If your dealing with her insurance on the vehicle, don't back down. On the medical side, be absolutely your all good, can take a long time.
Thank God she wasn't a couple feet further in man or you might not be here. A head on collision at a speed enough to make you do two spins would be horrendous.
Yeah I know I was lucky it wasn't head on, even though I don't feel too lucky. I will certainly be fighting the insurance, and will not sign off on the medical. I have had an X-ray I requested an MRI however, the doctor told me the insurance would probably not pay for it unless I try physical therapy first. Thanks for the help, doesn't seem right insurance pays the value and not to replace it. I have had a very hard time getting in contact with the agent, she never answers the phone and, takes a long time to call back. I am in the dark at the moment.
She's giving you trouble because claims relations is involved now. They're terrified of saying or doing anything that could force them to pay you a dime more than they want to try and get by with. Seriously, you need representation. Run, don't walk. One call that's or whatever you got in your area.
I'm not generally a litigious minded person, however,in this case, I'd secure a great white shark of a personal injury lawyer. You may be able to get enough, after his cut of course, to make yourself whole again in relationship to the jeep. Absolutely don't sign anything until you are completely satisfied. Especially physically. Your health and well being is paramount.
That's the way I am leaning. There is too much money involved to walk away from. Not to mention I could be hurt more than I think. Thanks for the help I will keep updating as I become in the loop. I will attempt to contact the insurance again.
Work with your Insurance. get an attorney. Re-couping your investment will be done by suing the other driver and her insurance. You have proof of your loss by receipt.
Don't admit or commit to anything for months down the road.
Glad there was not serious injury for you
My condolences on your loss, but you are healthy, and that's good. I hope the woman is also alright, as I'm sure, she is very sorry for this.
It is too bad after all the time, money and effort to get your Jeep ready that it is a complete loss,..... but now you have another chance to start again. Enjoy!
An insider's perspective...an attorney won't do you much good for the property damage as most injury lawyers work on a percentage of injury recovery. In fact, most won't even really help with the vehicle because they are not getting paid for that portion of the claim. You can certainly hire a lawyer on an hourly bases but it won't be worth it. Insurance companies, as a matter of law, only owe the actual cash value (replacement cost - depreciation). They will look for similar vehicles as a basis of valuation. There will be some adjustment that you will get for the upgrades.
As mentioned earlier, swap back any aftermarket parts you can. You will have some wiggle room in the property damage but you probably won't get near what you think your entitled too. For those reading with built rigs, if you want them covered at replacement cost, you have to purchase that policy.
As for injuries? That's a personal decision. If you are hurt, seek treatment. If you want to maximize your injury claim to help offset the property loss, find a personal injury lawyer who will direct you to the best care givers to build your claim.
Get a lawyer.
The insurance company has two issues to deal with, injury and damage. While each has its value, and damage will be hard for an "old" jeep, they can allocate more to injury, etc., to get it resolved. Now, you will pay for a lawyer, just like you pay for a plumber. But you will almost certainly end up with more in the end than going it alone. Lawyers and insurance companies have this process down to an art...you are just fresh meat by yourself.
I am currently at the ER my back feels much worse today. I am told its Lumbar Strain. I will be getting an attorney for the injury part of that's what I have to do to get a reasonable amount. I finally got ahold of the insurance company, we both have Progressive. They are trying to take the jeep to a yard to asses it (it's currently in my driveway). I am trying to get ahold of them because I'm not comfortable with that.
Not all accidents are the same, but MY insurance company went after the other person for me to recover the cost of replacing my vehicle. They paid out my claims including upgrades and then went after the other insurance company for recovery......
I didn't have full coverage on my jeep so I imagine that wouldn't be possible. I do intend to buy the jeep back though. With my back they way it is now removing the parts isn't going to happen. The engine only has 12k miles and there are a good few things still salvageable. I don't know for sure how bad the 8.8 is buy didn't look good from under it.
Also, make sure the attorney uses the loss of "proper servicing" thing for your significant other. When I was crunched I didn't have a girlfriend, but the attorney said I could get MUCH more $$$$ if the jury saw how my injuries prevented "certain activities". I thought he was lying, but it's true. That's how the system rolls.
I can't imagine the look on my fiancé,s face if the lawyer said that haha. I can't get ahold of the claim rep so I called customer service it is scheduled to be appraised Thursday at my house. She didn't seem overly confident that no one would tow it from my driveway so I will be wrapping the winch line around a tree with a padlock and post on the jeep that it is not to be towed. My claim rep also got a stern voicemail. A personal injury appraiser is calling me Monday.
If you are thinking of buying it back don't let it leave your driveway, you are not obligated to have them tow it to one of their lots. The adjuster can come to your house and look at it, if it leaves it will be more difficult to buy it back.
