Is yours a 4.2? Also, while I am not sure if it affects the header or not, the difference between carb and fuel injection maybe?

It's had a carb and I'm pretty sure it's not a 4.2

If it's the original motor, it's a 4.2. If it's been swapped out for something else you will need to figure out what it is. Post some pics.

to answer your question, if the motor is stock, yes the heads are different. check for a 4.2 header, borla and pacesetter make them. IMO its really not needed on a 4.2, the motor doesn't rev high enough to benefit from one. just get a hight flo cat and muffler in 2 1/2".

Unless you are in the military, you will need the cat to pass smog

I believe it's federal law to have a cat if your vehicle came with one and is used on road.

Raycer is correct. It is federal law. If the vehicle is licensed for the highway, DOESN'T matter which state you live in, it has to have a catalytic converter on it.

Doesn't matter what your state inspection laws are...
Doesn't matter if you need an inspection annually or not...
If it came with a cat on it from the factory (and there isn't a YJ out there that didn't) then it needs a cat on it.

Will you get busted for it? probably not.

To the OP, if it has a carb its a 4.2L motor, the 4.0L are multi-port injection and run a different head. If you cant find a header listed for the 4.2L then try looking for an 85 CJ7 with a 258 CID. (its the same motor)

I'm in California the yj will not be street legal for off rode use only it's the same as a sand Rail or dune buggy no emissions on a green sticker in California that's why I was looking for a header I want to run the stock 4.0 just looking for some bolt on power under the hood I looked at the OE manifold but was just thanking since mine is cracked replace it with a header . But I can only find 2 companies that make a header for the 89 yj

Not that I'd see the benefit of putting a header on a 4.2L, seeing as it'll reduce the low end torque for which the engine is pretty much designed to have, but here ya go:

Borla Performance 17062 - BORLA T-304 Stainless Steel Header for 88-90 Jeep® Wrangler YJ with 4.2L I-6 Engine - Quadratec

I was looking into a header on my 92, but a lot of the stuff I read says they aren't worth it. Something about jeeps being really torquey and cracks the headers. Would like to know if that's true or not.
