I apologize if I offended you for getting you to roll your window down so I can tell you that the law requires you to have a third brake light. I hope you didn't take that as me knowing everything, thinking you're stupid. But I kindly ask that you look into it. Here's a few direct points.

1. Texas law doesn't require it because the law refers to Federal Law and that DOES require it. Therefore, Texas does.

2. Yes you can pass emissions/ state test without one. Doesn't mean it's federally legal.

3. Saying you "used to" be a cop does not validate anything. Cops = people. We're all in the same boat on that one.

4. Also, if you were a cop then you should have already known about point # 1.


Yes, I'm a tool. But I don't like people waving around what they are or used to be to validate a mistake.

To anyone else on these forums debating this issue.

Texas Law refers to Federal Law that DOES require a Third Brake Light. Hope this answers some questions. I researched it for hours until I got a proper answer not someone opinion.

People here are generally incredibly nice and friendly, not saying this guy wasn't friendly but I wouldn't want to see anyone get a ticket for something they "thought" they knew.

My TJ has no 3rd light, due to tire carrier, and as long as I am passing state inspection I will not be spending mod money on something the state does not seem to require. The federal government can stick it.

Absolutely agree with you.

I guess here's the thing. You CAN get a ticket for it. But if you chose to not have it is your choice, just as I know a front plate is required but I chose not to have that on any car I own. It's a personal choice and a risk.

The federal government could certainly do a lot of things a whole lot better. I'm with you on the "stick it" part.

But should you ever chose to want third brake lights. I got $30 lug lights in the 2 lugs that the tire carrier doesn't need. It's a simple wire job and looks pretty cool. ( yes I'm bias ).

You just contradicted yourself... you don't run a front plate, which is also required, yet your concerned about someone choosing not to run a third brake light.....

And actually, if you read the law/rules about third brake light you are not required to have one. IF and ONLY if a third brake light is present, it is required and is required to be operational. IF there is not third brake light, then it is not required. You are only required to have a left and right at that time.

As for your $30 solution, you coulda bought a LED 2" or 2 1/2" round trailer clearance light for a few bucks and put it in the center of your spare tire and looked even cooler...

We don't follow federal guidelines for this stuff. That is why we have a state DOT. We operate by Texas DOT regulations, not federal. State of Texas regulations say you only need two brake lights.
