Okay, sorry I was away for a few days. My best friend got back from basic training for the Army Rangers...roadtrip/hotel party etc...
Back in April 2007, I was arrested in Hopatcong, NJ with 3 friends. My friend Kurt had a problem with a group of guys that knew his girlfriend from highschool (Ray, Austin and a few others). They invited her to the party and Kurt flipped the hell out. Once these punks found out that this pissed him off, they started leaving him voicemails about taking advantage of his girlfriend whilst she was drunk.
So, I find out where these guys live and Kurt, Nick, Kevin and myself roll over to the house. Nick sends Ray a text telling his to come outside. He comes out of the house with 8 of his buddies, all about 5'7"-5'9".
Nick was the star football player of my senior class, Kevin was the scapegoat
, Kurt is 5'8" and benches 350lbs, and I'm 6'5" 320lbs (at the time. I'm 280 now) and have punched holes through 2" thick solid oak doors.
I've got the brass knuckles, and Kurt, being the colossal DUMBASS that he is, bring a PELLET GUN TO SHOW OFF!!! It looked like a standard police issue firearm, no orange cap, or nothing.
Once these kids saw me, they backed off and said they didn't want trouble. I got in my Jeep and had Kurt, Nick and Kevin fallow me in Kurt's Jaguar (We all grew up in Sparta
)...as we pass the group of kids, KURT FLASHES THE GUN! They run in the house and call the cops, and tell them about a gun in a silver Jag (we have no idea they are calling the cops, and I have no idea that Kurt flashed the gun).
We are flying through Hopatcong, and right before we get out, we pull over to figure out what we wanna do now. About 45 seconds go by and 2 Hopatcong cops fly past the parkinglot we were in, going about 65MPH on a residential road. They slam on the brakes, pull a 180 and pull up behind Kurt's car. The arresting cop (Joe Magrini) gets out and draws his gun, and orders them to get out of the car. Magrini finds the gun, all 3 are handcuffed and put in the bacon-mobiles. By this time, I'm still sitting in my Jeep and 2 MORE cops roll onto the scene.
Magrini comes up to me, and asks if I'm with the rest of the group. I say, "yes". He asks me my name. I say, "Sean Flood".....he has a puzzled look on his face and asks, "Are you related to Bill Flood?".....I say, "yes, he's my uncle". Apparently, Magrini was the one that arrested him on his DWI charge.
He pulls me out of my Jeep and cuffs me, pats me down, etc. He says I'm being "Temporarily Detained". Then he asks to search the Jeep. I told him bluntly, No. He asked me why and I said, "because I know my rights, and you don't have a warrant or probable cause". HE SEARCHED ANYWAY! He found the brass knuckles, 2 more knives and a baseball bat.
I was charged with possession of brass knuckles
Kurt was charged with possession of a firearm, aggravated assault with a deadly weapon, and criminal mischief.
Nick wasn't charged, and niether was Kevin, because he was only 17.
Kevin was released to his parents, and Kurt, Nick and myself were released on recognance a 6hrs later.
Kurt was sentenced in October 2007 to 2yrs probation and 100hrs community service.
I was sentenced in July 2007 to 1yr PTI (Pre-trial Intervention)...I then violated PTI in September with a bullshit theft/credit card fraud charge.
I missed the court date for the status conference, which got me the bench warrant that I turned myself in on in December, and spend 3 days in county jail for.
I was originally going to be sentenced to a year of probation for the violation, but once the judge found out that I'm in the Army, he remanded the 1 yr probation so I didn't have a felony on my record, and sentenced me to 3 days in county jail. Because I had already spend 3 days in county jail, those 3 days were credited to my sentence, so all I got was a $530 fine.
