Happy Repeal Day!!!

Happy Repeal day to one and all. I hope you all enjoy a drink or two tonight to celebrate the return of freedom on this anniversary of the day the ony admendment to the constitution that prohibited a freedom instead of guaranteeing a freedom was repealed.

I'll be having a sip or two of bourbon myself.

He's referring to the twenty first amendment to the United States Constitution which was ratified on December 5, 1933. The twenty first amendment repealed the eighteenth amendment also known as prohibition.

Actually, California didn't ban anything. This is the actual text of Prop 8 for those who haven't bothered to look it up.

If you want to mince words and get really technical, it only states that California does not recognize gay marriages. That does not mean however that two people can't make a commitment to each other and be "married" regardless of their gender.

But it wouldn't be a legally binding marriage. It wouldn't allow them the legal benefits of marriage which is supposed to be what this is all about. Proposition 8 did ban gay marriage in a legal sense and that's the only thing that matters since we're discussing law here.

Personally,and for the record, I think it's repugnant that the government has anything at all to do with marriage,

As do I, though I don't care about the record. The proposition, which I voted against, bans nothing in the legal sense. Anyone can make a commitment to each other.

The government (read "the people") has chosen that matching genders who marry are not afforded the perks given to non matching genders who marry. A piece of paper does not a marriage make, and the government can't keep two people apart unless one (or two) are underage or aren't citizens.

It's splitting hairs, but I believe that is why the prop was worded the way it was. Had it outright said gay people cannot be married it may have not passed.
