improper passing ticket first one.

so i was driving my buddys new car and my brian fudged up the passing markers and got an improper passing ticket, this is my first ticket, the officer told me to contact the court and talk to a judge with the name that starts with a M, magstriy?, but i looked onn a website for my county and it says 105dollar fine and 3 points, anyone got tips for me cause this is my first one, cops says the judge is pretty lean with seomone who doesnt have anything else like me.

whoooooooooooooo hey pal hahahaha that is awesome i have gotten two reckless tickets for "improper passing" and then a cop in my jeep club laughed when i passed around a double yellow..i guess a common occurence for me! but i imagine it will be reduced, they have ways of making it that way. good luck, i have like negative 5 points after my dip calss...i think i had like -8 points or something. good luck

If you go to court and traffic school and watch movies of people getting killed I think you can get the fine/points waived.

Ask the public defender about knocking it down from improper passing to "unsafe" operation. It's no points, but a higher fine. In Jersey its actually $400 more.

The court will let you set up a payment plan of $50 a month if you need to, just as long as you pay it.

I already tried

The only reason that the judge didn't have the chance to throw the book at me is because I was friends with the cops. Notice I said COPS.

They had 3 to pull me over. And I never even got a warning

the prosecutor is who you'll talk to. theyre not gonna give you a PD for a 100 dollar ticket. just ask for deferred adjudication. its probation plus court costs. no more tickets in 90 days and it goes away.......

yeah like they all said just plea bargain with the prosecutor. They dont wanna be there as much as you dont, theyll work with you.

I had 2 speeders with a total of close to $500 and a total of 8 points knocked down to $250 and 4 points so basically kinda got away with one.

i called the court today and said the ticket wont get there till next week and asked some questions. i have 3 options, plead guilty and pay the fee, plead guilty with an explnation, or plead not guilty and go to court? im thinking of guilty with explnation and tell the judge what happened and hopefully he takes the points away.

Hey Sappi, its your money and points, but unless you had a pregnant woman in the car or you were bleeding profusely from your head the judge will give you the points and fine and court cost just for thinking that you could explain your way out.

I'm telling you out of experience, plead guilty, talk to the prosecutor about a plea agreement and take what you can get.

On your court date, you can go infront of the judge and plead guilty, not guilty, or no contest which is the same as a guilty plea. if you plead not guilty or no contest the judge will listen to your side of the story and then the cops and make his decision. That would be called a Bench trail. Where the judge hears the case.

You also have the right to request a Jury Trail. A jury trail would be a waste of time over a ticket like that imo.

Another option is to go talk to the clerk of court before the court date and pay the ticket early. Some courts do this and some dont. Sometimes the clerk can cut you a break on the fine and you dont have to worry about going in to court.

I always have pled, and been told to plead not guilty. That way you get to talk to the DA or ADA and ask for a reduction in the offense or penalty. They are usually pretty good about that and be sure to mention that its the first time youve ever gotten any type of ticket. Good luck.

I beat a ticket recently (stop sign) with the "guilty with expanation" defense.
Bring photos of the controls of the vehicle. Lots of photos with arrows, circles, and lines; they like that.

X2- unless you have a nun as a witness (or something on video) pleading not guilty is like challenging the system. Depending on the circumstances and mood of the judge, you might do yourself a huge disservice challenging the court and they might throw the book at you. I highly suggest you wear your best suit to your hearing. A hair cut and a shave is also part of the deal.

I once got a pass from a judge on a hit and run charge because according to him:"I appeared to look like an upstanding young man".... I didn't realize I was looking at jail time for it either until he told me what the sentence could have been. I also had a spotless record.

It was a really stupid case too. A couple of girls came out of a bar one night and sideswiped my Jeep. When I pulled over, they took off. I didn't report the accident and I went to the hills to go partying. When I got back, the local cops were there to hand me a ticket for leaving the scene. Turns out the girls went straight to the police station.. In Jersey, if you leave the scene of an accident, it's assumed you were drunk and they were cracking down hard on these types of cases.

You have nothing but your looks, your attitude and your record for the judge to go on and first impressions mean everything. Go to court looking like a bum with a self righteuous attitude and plead not guilty...you'll be done before you get two words in.
