I explained when the jury gave the verdict they gave a not guilty on 2nd degree AND manslaughter, meaning he can not be charged with it again. Then I explained how the only crime the Feds could get him on was a hate crime, and how they could never prove it.

He wasn't having any of it. I got tired of giving him facts and explaining criminal law to him.

Just tired of hearing the hatred. I can understand being upset but the hatred over race is just pissing me off.
I don't want to get into the specifics of the Zimmerman case, but you were actually wrong about double jeopardy. Zimmerman was tried in a Florida court, so there would be no double jeopardy in federal court.

Edited to add: You were right that they can't charge him with murder though, because they can't exercise federal jurisdiction over an in-state homicide. There are plenty of federal civil rights crimes that they could tag him with though. So you were half right!

I see your point, and then again i don't. That would be using the same justice system at 2 different levels to try you of the same crime you just got your law degree so please explain how that is possible?

Also, for it to be a federal murder crime, certain things must be met correct?

Sure- I'll give it a shot. Double jeopardy only applies to one particular jurisdiction. So now that the state of florida has taken a crack at convicting him, they can't try again without violating double jeopardy. But federal courts are not a "different level"- they are an entirely different jurisdiction. So IF the feds could charge him with murder, they wouldn't be blocked from doing so by double jeopardy.

But in order for a court to exert authority over an individual, it must have what's called subject matter jurisdiction. There is no applicable federal murder statute with which to charge Zimmerman, so he can't be charged for murder in federal court. (There ARE federal murder statutes, but only for crimes occurring on federal land)

Another edit: BUT let's say that Florida hypothetically charged him with violating a civil rights statute that was identical to a federal statute. Double jeopardy would not bar the feds from prosecuting him afterwards under the federal statute.

As much as I despise AG Holder, even he has said it would be hard to convict. Especially since the FBI has found no evidence of a "hate crime"
