fender flares

Got a question for everyone here in Nebraska? Ill be going to 33x12.5r15 tires this coming taxes and im wondering if my fender flares have to cover my whole tire?

Technically I think so but I've seen tons of vehicles with tires sticking out past the fenders on trucks and whatnot. Here's a link. http://statutes.laws.com/nebraska/Chapter60/60-6_283

for the last 3 years I have been running 35's with fenders that are maybe 1-1/2 inch wide.. some times no fenders at all for months in the summer.
