Little bump in the road this AM

So I am heading down to work in Woods Hold going around the Borne Rotary and this jack nut come screaming onto the rotary straight to the left lane and hits the passenger side front of my Jeep. I was pretty pissed till I seen the damage and then I could not help but laugh at him.

Little blue paint on my Bumper.
.

His car. Rear quarter panel, tail light assembly and bumper is jacked. Impact was at about 10-15mph enough to almost spin him around *L*

Did you ask him if he knew a good shop to buff out your bumper for you?

Glad nothing major happened to you or your ride! also, good thing you posted this in the MA section. The rest of the country wouldn't know what a "rotary" is....

Typical d!ckhead in a Volvo. Like most people, he obviously has no idea how to operate a M/V in , around, and back out of a Rotary! Jacka$$

Some people just don't know how to drive in a rotary. Wait till you see someone drive the wrong way into a rotary. Everyone within a half mile is laying on their horn

Well he ran a yield sign and I have been foun at fault bu his insurance company... This sux..

That is absolute BULLSHIT

You need to have YOUR insurance company all over his insurance companies ass.

If you were already in rorary traffic you have the right of way.
MGL C89 S8 states as follows:

Section 8.
When two vehicles approach or enter an intersection of any ways, as defined in section one of chapter ninety, at approximately the same instant, the operator of the vehicle on the left shall yield the right-of-way to the vehicle on the right. Any operator intending to turn left, in an intersection, across the path or lane of vehicles approaching from the opposite direction shall, before turning, yield the right-of-way until such time as the left turn can be made with reasonable safety. Any operator of a vehicle entering a rotary intersection shall yield the right-of-way to any vehicle already in the intersection. The foregoing provisions of this section shall not apply when an operator is otherwise directed by a police officer, or by a traffic regulating sign, device or signal lawfully erected and maintained in accordance with the provisions of section two of chapter eighty-five and, where so required with the written approval of the department of highways and while such approval is in effect.

No offense but, who care what HIS insurance company says? That is why you pay such high premiums, make them represent you and handle this. Of course his company says you're at fault, that's how they should handle the claim for their client.
Be sure to mention how you tweaked your knee in the accident, maybe bumped your head a little. Things will change quickly.
DO NOT SETTLE for being at fault.

Well one thing being in the Military has taught me is document and fight like Hell. So basically his insurance company found me at fault. They are being a real pain so I am indeed seeking damages I am going to make them have my push bar re painted. There is one little spot of bare metal and all you North East folk can surely agree that bare metal won’t last long here. Yes I could repaint it myself but due to their (Geico Insurance) attitude, and the way they have treated me they are going to hopefully wind up paying to have my Push bar re-coated. Some of you might think this is a little childish of me but let something happen to your belongings and have the contributor’s insurance company tell you that your damage is not serious and they do not warrant repair. Basically IMO it was not scratched before the accident he is responsible had I done this off road I would be fine because that is part of the off road game, got to pay to play.
So in short they say I am responsible and will require either my insurance company or me personally to pay (the 2nd part I don’t think they can do that is why I have insurance).

My concern is his car 1995 Volvo 850 Turbo, VIA KBB is only worth about $2800 in Excellent condition see how it is 18 years old, and the damages consisted of
Rear quarter panel,
Bumper,
Trunk,
Tail light assembly

It is likely his car will be totaled due to the cost of repair is much higher that the value.

Here is a little insight that I provided to his and my insurance company. My insurance company loves me because I make their job easy.. *L*

my insurance company is fighting for me as well as I am fighting to them. I do not want my Insurance to settle and pay for his damages just to end this. As well that would increase my premium. So at this point I am going to paly hard ball and they will pay to have my pre Runner re painted/replaced If I have my way.

Fight this tooth and nail!
By right this accident should have been written up on scene by the local PD since there was over $1000 damage to the other vehicle. That would have put an end to the "who's at fault" bickering by the GEICO because Mr. Fischer would have (should have) been cited for failure to yield right of way.

Good luck to you!! And looks like you're doing a great job! It took me almost a year to prove I wasn't at fault when I was hit HEAD ON by a drunk driver! MA is REALLY screwed up to enforcing their own rules...

Boy that's an understatement! It's the only place that I've seen that both drivers in a accident can be found 51% at fault! But then again, why not? Surcharge both drivers and make more money! That's the name of the game isn't it? (And yes I still use the term "accident" to describe an MVA. I refuse to use the new term "crash" because I think it's asinine. Sounds like what little kids say when playing with toy cars!)

Awesome job HAFICON! I must point out though, it looks as though you may be partially at fault. According to your sketch of the accident, you were driving pretty erratically. Go back and look at your blue line, you were all over the place.

Isn't it pathetic how the innocent must defend and prove themselves? I can't imagine being the driver of the Volvo and not just admitting fault and moving on. I assume the two of you decided to move on without Police involvement? Had an officer arrived you probably would have had a police report showing his fault.

btw: who's your insurance company?
Police in Ma do not do accident reports. It takes almost making a threat just to have an officer come out. Was in an a Cosentino a while back had to call 3 times askin for an officer the 911 operator refused to send one out because no one was hurt. When the officer did come out he refused to get out of his car.

Well maybe that's true of the departments up the Cape, but we get dispatched to every inconsequential matter that’s called in to the department. I do realize that larger departments have had to cut back due to loss of man power, but believe me when I say I write PLENTY of accident reports.

Mine will do it, but that's because its a quiet town and they don't have too much else to do. You'll never get a state trooper to write one unless you crash into a cruiser
