Why bother with the OHV registration?

OHV registrations are for operating an "Off Highway Vehicle" on an off road/highway “trail” (upon State owned property) that PERMITS OHV use. Do you really know of any??? Let's face it, 99% of us wheel in areas that we really shouldn't be, like dirt bike/ATV trails, power lines, gas lines etc.. I think an OHV permit would be the least of your worries if an EPO wants to be a prick.

However, if you’re operating your Jeep on a public way, even if said public way is an old unmaintained road, (i.e. Copicut, Quanapog, OFR, etc.) you’re still operating on a PUBLIC WAY.

Under MGL a public way is defined as:

"any way or in any place to which the public has a right of access, or upon any way or in any place to which members of the public have access as invitees or licensees"

Therefore if your vehicle is legally registered, insured, and inspected - I see no need for an OHV permit/registration.

The next time I am over in court I am going to run some of the finer points of this law by the Clerk Magistrates. I have a feeling however, that I'm going to get a lot of "shoulder shrugging" on this one. This State legislature is fantastic for pulling new laws out of their ass and, at the same time giving Law Enforcement and the Court system, no way to deal with it! For S&G's read the two latest abortions they created, the non-criminal marijuana statute, and the abolishment of the CHINS statute for dealing with juvenile offenders! Talk about a Joke!

The only thing on the minds of these idiot Legislators, is the revenue that will be generated through the collection of fines. The constitutionality of the law, or the ability to properly enforce it never enters into their little pea brains.

I really hope a few of the clubs get together and pool their resources to challenge one of these violations all the way up to the MA SJC so we can have some case law on it one way or the other.

I didn't expect to run into laws like these. Back home, there were trails everywhere and you'd see people of all career fields, including LE, out there. It was never even a topic of convo. We policed ourselves and if anyone was littering, we'd make sure they left the area as they entered it...If someone got stuck blocking the way, we'd even do a cigarette butt roundup while the others worked the issue. It was fun with no hassles. I can see the EP's point of view on keeping the area protected. But most of us want the same. Most people out on the trails are mature enough to preserve these areas. The only hazmat problem I've ever run into was watching an old Toyota pierce his oil pan on a trail and spilled oil everywhere. After we got it towed out, we shoveled the spill mess into an empty cooler so he could dump it at the nearest oil collection point (Wal-Mart auto center). Almost makes me think... Man, Cali may seem great, but I lived up north in the Bay Area for a few years and it was getting a lot like this. I got my first Jeep YJ back in the late 90's so I could take around lake Tahoe, Berryesa, and the hills around SF. But as much as I love Cali, I hate SD. And I've grown to hate my ex as well.

There's supposed to be a Meet and Greet Saturday for anyone in the Canaan, CT area. I may drop down but I think it's just a parking lot meet where everyone stares at everyone else's rigs...I may go just to go and see if I can sell some parts or even find someone selling some...never know...

Thinking about heading over this weekend. Any idea what there is to do out there?
Everything I am reading it is not legal for Jeeps or 4x4 vehicles.

I might try looking into some Class VI roads over in NH, I do not want nor can I afford for this military guy to get in trouble. Also if it is not legal I don’t want any part of it, Just need to find some good old Jeep trails with decent terrain and some folks to ride with.

Good info but correct me if I am wrong. From what I am reading a OHV is an ATV under 1000lbs. I specifically read 44 and Jeeps over 1000lbs are not permitted.

OHV - Off Highway Vehicle a stupid acronym that the state made up.
And correct, they are not allowed on Dirtbike trails or ATV/Dirtbike trails. The trail would have to be OHV approved to drive a Jeep or other 4WD vehicle on it. - Find me one!

I think that is easy.. Look outside the state of Mass. *L* I dont see why this place does not have something set aside I would even pay per use monthly or yearly fees.

there is like one trail here on base takes maybe 5 minutes to ride the whole thing, almost a waste of time.

Well if anyone has anything going on I love to turn wrenches and have access to a really nice shop, 2nd love is working on or around Jeeps.

Hey Guys,

Next weekend is the Bantam Jeep Heritage Festival in Butler, PA. I had planned on going with my daughter, however due to a transfer she took at work, she will no longer have the weekend off. I'm kinda at a loss as to whom to ask to go as she and I are the only Jeep nuts in the family/friends circle and I think the weekend would be lost on someone not into Jeeps.

If anyone is interested in going, the weekend is planned, booked, and paid for. It's a Fri, Sat, Sun event. Just so you know it's about a 9 hour drive from SE Mass. PM me if your interested or have any questions.
