no 3rd brake illegal in NJ?

hey people just have a quick question...was wondering if having NO 3rd brake is illegal in NJ? will i pass inspection? im going to be getting a lift and bigger tires so i will need to remove the 3rd brake light (which isnt even hook up anyways) to fit the spare on the tailgate. was wondering if any of you have been through inspection without a 3rd brakelight and had no issues...

The law in New Jersey states that there is a 2 tail light minimum.

if your vehicle is equipped with a 3rd brake light (mandatory for any vehicle made after 1986) it must be present and it must function. also, if someone rear ends you, you may be held partially at fault, and their insurance may refuse to pay any claims. it would be in your best interest to make sure it works and is visible.

as far as passing inspection is concerned, that is a "safety" issue not an "emissions" issue. as of a few months ago NJ did away with safety inspection in an effort to save $$$ in the budget. if you go to inspection without the light, or with the light not working they shouldn't fail you for it.

No Inspection needed

Hi!

To answer your question I found the link to the new inspection law on the NJ dmv site. heres the link, FYI it opens a .pdf file. It states that only emissions need to pass, so I think you're in the clear.

I myself have a 95 wrangler and I currently don't have a spare tire or third brake light. I had my jeep inspected WITH the brake light but then removed everything after, and I have been driving without it for over a year and never had a cop or law enforcement pull me over or hassle me regarding it. hope this helps!

ok cool thanks a lot everyone! i had a feeling since we got rid of the saftey issue part of inspection i would be ok but i just wanted to make sure.

i just took mine through inspection this month, they didn't even bother me about the tires sticking out past the fender flares.

I don't see how this would be a valid law since Older Jeeps like YJ's and CJ's came stock with no 3rd light

They have changed the rules a whole lot in NJ past year. Having the luck to work at a shop that does inspections i do my own. Inspection stations are starting to shut down with in the year and years to come and the small privately own shops will be the guys to do all the inspections soon enough. If you go to a private shop some check hardcore to make money off your repairs, and some just want to get you in and out since it is somewhat of a PAIN to do an inspection. At the DMV stations it all depends on if the person had a good night or day at the time of your arrival.

I have had some customers fail for the dumbest things, and pass for the obvious. So who knows any more. But as long as you have 2 working brake lights i doubt the morons they got working for the DMV place will know anything anyway.

Had a lady with a bmw fail because they could not find the OBD2 port. Crazy!

I just installed a Smittybilt bumper with tire swing and got rid of my third brake light. I did do the center 3rd brake light in the hub of my spare took less than an our and about 10$. Just to be safe from a cop in a bad mood
