Well it is good to here that your going to be taken care of and that things are working out.
As for skeeters comment on UPS drivers not being better.......That may be true but from what I have seen of the 18 wheelers I would have guessed UPS has better drivers. In the winter of 06 I made a trip from Oregon to Kansas and on one long hill I saw 2 or 3 jack-knifed FedEx trucks, several more stuck on the side of the road and 2 FedEx trailers all by themselves torn up (1 upside down and the other on its side) and the boxes scattered everywhere in the center median. I did not see one UPS truck jack-knifed or overturned truck. I did see a number of them that were stuck and several that were parked at the top and bottom. That is just an observation. I'm not saying one is better than the other.

|jgano23||i actually went with the teraflex disco's b/c the collision shop needed them the next day and i wouldn't have the JKS ones until a few days later. so i was not real happy about that but what was i gunna do?|

|jgano23||just an update on the Fedex situation. Fedex has decided to assume full responsibility for the accident (seeing as how it was their fault). they have paid my insurance company and are sending me the $1000 deductible. i am still mad about the accident and am still jeep-less, but it is nice finally having an answer as to what is going to happen. hopefully my jeep will be finished in the next 2 weeks or so.|

I understand you being upset but you haven't even seen the settlement offer yet have you?
You won't get screwed as long as you have a decent attorney and your insurance should have provided one for you. Let the attorney handle all contact with FedEx's representatives.

You are not dealing with FedEx at this point, you are dealing with the insurance company.
Getting upset may make you feel better but it will not help your case at all.
The driver did not want to cause an accident, he did not want to hurt you. he screwed up and believe, me he's going to pay for it for the rest of his career.
BTW, UPS does not have any better drivers than FedEx.
I've worked with them as well.

well, i got the estimate in the mail for the damage. it came to a whopping $6,024.91.
it needs new:
driver side mirror
as for repairs to the salvageable parts:
spring perch to be repaired
frame repair b/c it was "dented in" (whatever that means)
paint job on entire front end
woo, freakin, hoo.

|jgano23||wow, that sucks. at least i know this ass has insurance and major corporate backing. i am hoping that they replace the parts with aftermarket and not oem. i had a smittybuilt tube bumper and quick disconnects and some other aftermarket parts that were destroyed. the collision center said that they are required to give the vehicle back to me in the original condition (original meaning like it was before i was hit). so that is good, she said all i have to do is tell them what parts and where they can get them and they will replace them. hopefully tomorrow i will hear back about the damage report so i can start researching. btw, i will not be price shopping i am going to find the most expensive parts i can so that fedex can pay for them. and i am going to get them from quadratec b/c they only ship ups to my area, so they'll have ot pay for the shipping too. (i'm still pissed can you tell).|

jgano, i had this happen to me. But, the guy who hit me was an illegal-alien with no insurance. I noticed he had expired tags before I got out of my pick-up. This REALLY pissed me off. I got out of the truck and started picking up the peices of my pick-up that might cause problems for cars passing by, watching the other driver who wasn't getting out of his car. I walked to his car, his window was up and he looked OK. He kept looking away. So I asked him to exit his vehicle, he refused my offer. He could see I was mad I guess. So, I had all the car parts in my hands................ and proceeded to pelt his window with all of it until I was pulled away harshly by a cop who showed up that I did not see. The cop took statements from him and I, and still the guy would not get out of his car until I left.
My insurance had to pay for the accident, but I got some really cool after market parts. I don't know what ever happened to the other guy.

Sorry to hear your misfortune and hope everything works out.
Reminds me of when I was at Wyotec going to school..
A guy that lived in a apartment next to mine was driving home to Texas on the interstate in his CJ7 fully restored.. ( it was perfect ) anyway a grayhound bus pulled out in front of him while he was going 65 and totaled it. He was in the hospital for a week. Greyhound settled with him before he was even out of the hospital for a large sum of money and bought him a brand new Rubi that he drove back to Wyoming the following month.. Last time I heard he had healed completely.
In my opinion Fedex should pony up for the damage and quit being A-holes and deliver my jeep parts that have not come yet

|jgano23||ya, i probably would have too, but the only thing the guy said to me was "I'm ok, are you ok." I said "ya" in a not so happy way and then the guy went and stayed in his truck for the rest of the time. What i should have said is"Ya, you rotten b@st@rd, i'm gunna ram all of those oh so important packages so far down your throat you will be sh!tt!ng christmas presents for the next year." can you tell i'm still a little angry?|

|jgano23||so, in a previous post i mentioned that the day after the accident we saw the driver almost cause another accident. well, after that my husband called and made a formal complaint to fedex about the driver. fedex told us that this driver does not work directly for fedex. he works for an outside contractor that delivers for fedex but it is still under the fedex umbrella. the fedex rep did assure me that the complaint is formally documented and that it will be given directly to the supervisor of the outside contractor. he also said that fedex is aware of the accident and that is does not look good for the driver that there is a formal complaint and that he almost caused another accident. actuall the fedex rep did not say "caused an accident" he said "was in another accident", i guess that they flat out refuse to admit any fault at all.|

|jgano23||ok so here's the update. i saw my jeep yesterday and it is not as bad as i, and the tow truck guy, thought. the suspension is fine, although it does need the new grille, fenders, cowel, hood, radiator, etc. I think the intense rage i was feeling clouded my judgement on the damage. The collision center has to check to make sure the axle is ok b/c after the guy hit my fender he made contact with the tire. it still sucks b/c i won't have my jeep for a few weeks and i still have to pay the $1000 deductible (it will be reembursed but not for a while).|

That really stinks that happened to you. Good luck with your claim. If I remember correctly, Jersey gives you 24 hrs. to seek medical attention following an accident. Otherwise, you are considered OK and lose the right to sue under your car insurance. Assuming you signed the tort threshold option (which most people do to lower the liability insurance premiums by 60%), you would also need to accrue more than $1200 in medical bills to be considered for compensatory damages (pain and suffering).
Otherwise, it's a pretty solid case you have against Fed Ex. especialy since the other driver was cited. Basically, it will be limited to the damages on your Jeep. I would secure 2 or 3 estimates for the damages + cost of a rental. You will most likley have to pay for an estimate but will be reimbursed through the process.
Next time you whacked, don't hesitate to go to the emergency room for a check up.

Good luck with resolving the accident. I am still fighting to get repairs from mine and will likely end up in court due to the "at fault" driver not having insurance.
