|Jmaggi||Well I talked to the dealer that sold me the car on the phone yesterday and am awaiting a call back today. If I do not get a call back by the end of the day I will be making a trip tomorrow. I know there is a good chance I will get nowhere but I will go down guns blazing for sure.|

I would go back and raise all hell. They didnt give you something you paid for and made a false advertisement.
If they start giving you problems make sure you make a big enough stink that other customers can see and hear whats going on. That usually gets management a little nervous. Make sure you bring paperwork with you that states the hardtop is included. Make copies before you go so you have extras just incase. Tell them you spoke to your lawyer and he's ready to back you up and help out getting your missing hardtop.

If the paperwork from the KIA dealership says hardtop then you paid for a hardtop. I would go back and demand a hardtop. If they don't have one then I would demand that they take off atleast $2,770.00 off the price of the Jeep, that's what an after market top would cost you.
I would really like to have $2,770.00 taken off my bill due to a "stealership" error any day, push the issue, what could it hurt.

It was labeled as "hard top" on a list that also included things such as "auto", two door, 4wd , etc. So that leads me to believe that it was just coppied from the manufacturers description so odds are I will not get anywhere with the dealer. But, I will try...couldn't hurt. Btw it is comforting to hear that I will be okay with the soft top.|

if it was the dealer paperwork that said "with Hardtop" than i would go back and get it because you payed for it.
if "with hardtop" was on factory info, then forget it. not a big deal

You bought it used and typically used vehicles are labeled as being purchased "as-is"... therefore they do not owe you anything. If the hard top was sold by the previous owner, they won't be able to give it to you.
Living in Ohio where we get plenty of cold weather and snow...you'll be absolutely fine with a soft top. The heater in your Jeep will have you opening your windows on 0*F days soft top or hard top. lol
...sorry, I may have mis-read this...are you saying the dealer's ad says it came with a hard top? If that's the case...question them on it. They may say they just made a mistake and you won't get anything...or they may have it laying around in storage and it was just forgotten about. If nothing else, you'll have a top that you could sell off for an extra $600-800!

got my TJ from a dealer...
About three weeks ago I picked up my '04 TJ from a Kia dealership, and was just reading the vehicle discription for whatever reason...anyway it says that it came with a hard top; which I do not have. Now I k ow I should have noticed this before, but the truth is I was way too excited about driving my jeep home. My question is...what should I do? Should I get with the dealer and try to get a hard top out of them? Or should I live with just having the soft top and get a hard top later on down the road?...seeing as how I'm in this spot because I was retarded enough not to look earlier.
