On the flip side I do 100% agree with you on 90% of FCA products and dealers being total shit.
You are much to generous. The law does not allow emotional distress damages for purely property damage. And the law does not recognize stigma damages for personal property in this situation. Whoever it was above who said "you would lose" hit it dead on.

Might want to re-read post number 1.

On two occasions I had shops forget to put on lugs or tighten lugs. I now do a walk around before I leave the lot if the wheels have been removed.Mistakes happen and I don't want to be a casualty of a mistake.

Maybe OP is sworn to silence. For all we know legal action could be filed. Let's not bash the OP. Now he knows he has to inspect a dealers work. 1st time shame on them. 2nd time.. I for one, am hoping he is getting taken care of.

Hey all,

Sorry for the radio silence. I've been waiting on getting something solid to pass instead of going back and forth all day.

There's absolutely nothing to sue over. If you're an attorney and believe so, please contact me. I've spoken with just one who was very helpful. I didn't even ask if there was a case, I simply explained the situation and he advised me. The dealer (SM) was certainly looking out for his own interests in telling me and the Civic owner not to go through insurance BUT it is also in our best interest as well. It prevents a CarFax incident and the resulting vehicle devalue. The lawyer told me I need to get a "No Harm" statement (I forget precisely what it's called) which will prevent me or my insurance from having any liability if the civic owner decides to attempt some sort of case against me down the road.

As far as damages they fail to repair im going to have the most reputable licenses 4x4 shop near me evaluate their work and if there are remaining repairs I'll take it back to the dealership and my warranty will mandate any fixes. These are FACTS. I'm using this same 4x4 shop to do my regear to 4.56.

I did ask the dealer about a regear and this is where I got angry (justifiably or not it's how I felt) because they essentially told me they cannot do a flat rate and if they reassemble the diffs and something needs adjusting they'll have to disassemble, fix it, etc. all of this is hours billed. SM offered a discount but didn't specify an amount and said it'd potentially costs thousands.

Demanding a new Jeep is outlandish. The more and more I've researched this and reached out the more I've realized it. I too wish businesses would be honorable and all that and rely on word of mouth etc but unfortunately that isn't the world we live in. You don't become a multi billion dollar corporation by doing hay. Also lamentable but still facts.

I reached out to Jeep and climbed the chain of customer service representatives and after explaining everything several times they're taking this very seriously. I asked if they have any legitimate control over a privately owned dealership and the guy sort of chuckled and said "yes, we can absolutely direct them." Take what you will from that. I have no idea what they'll do at all and I'm waiting on their call. I'll let you guys know when it happens though. I'm not expecting Jeep to do anything for me but I do expect them to take some sort of action 'against' the dealership. Safety precautions or checking work or something like that if I had to speculate.

The Jeep has been in their hands for 9 days now. They're were waiting on my replacement fender from paint and now for the replacement wheel from Tire Discount. This is really what made me contact Jeep and try to shake the tree. It was mostly spite, I'll be honest. I'm angry. They should have overnighted that wheel. They should have made one appear out of thin air for all I care. All I know is if they had ordered it the next day and had put a rush on my fender for paint I'd have my Jeep. I don't and that's because I wasn't a priority. So when Jeep gets back to me I'm going to email the holding company who owns the dealership and do my damndest to find anyone with any sort of ties to this dealership and let them know about my displeasure.

Sure the dealership CAN give me free stuff. Bill Gates CAN give me free money. They doesn't mean they ever will, and just like you have no recourse to force Bill to give you a billion I have no means to force this dealership to do anything further for me or to make me a priority in just making me whole again. Nothing about being a chump or whatever nonsense else was posted. It's simply either extortion or fantasy. Frankly I want nothing further from this dealership. I know precisely where they stand in my mind and me in theirs.

I'm always amused at the words people will use on the internet but never, ever utter within earshot. Chump and all that comes to mind.

I seriously SERIOUSLY! Appreciate all of your guys help and guidance. I'm blown away by how active and passionate this community is even if it's passionate about calling me a clown for not checking the lug nuts haha

Nice! You did the perfect thing. Sought some good legal advice and having a reputable 4x4 shop do a 3rd party estimate. Keep in good with the stinky ol dealer for warranty issues and go to the 4x4 shop or reputable mechanic for everything else.

That wheel should have been ready to go yesterday. I guess they don't want you to think you have them by the shortys. Glad your on the right road though! Good luck and keep us posted

The lawyer would be referring to a "defense, indemnity, hold harmless" agreement. You can get them online. Definitely a good idea to force the dealer to acknowledge any claims by the Honda are their problem

The Release of Liability Future claims isn't a bad idea, probably over kill but when asked a Lawyer worth their salt is duty bound to suggest.
They are State specific but available to "build" online.
