I'm new to the forum and am not able to find where to do a full text search, so please forgive me if this has been covered.

I was finally to get my Gobi Rack next week after placing the order on Dec 1st last year. I get a call from them today to learn Trail Duty has gone out of business (owner passed away) and that they will need to collect payment from me directly if I want the rack. Of course I already paid Trail Duty when I placed the order.

Is anyone else in this situation? Any lawyers around? Does it sound right that they would expect to collect from me instead of from the assets of Trail Duty?

Who is "them" and "they" in the statement above? Are "them/they" part of the Trail Duty organization whose owner died? Why do "they/them" have the product that you already paid for?

Lots of potential legalities involved. Read: this sucks.
 
im in the exact same situation...ordered my rack from trail duty in November last year. its supposed to be shipped to me this week and Gobi wanted me to call trail duty and contest the charge.
here's hoping i actually get the rack!

Are you being successful in disputing the change from November? I am going to consult with a lawyer fried later today.

I spoke to several other business people over the weekend and to a person they all agreed that it is Gobi’s responsibility to work to collect from Trail Duty and not try to stick their customers with that burden. Although out of business, it is not uncommon to make claims against the remaining assets of a business. It will take time and effort, but that’s part of the cost of doing business and honoring customer commitments is paramount.

To add insult to injury, Gobi stands to gain significantly by this development. Gobi is asking Trail Duty customers to pay full price for racks they otherwise would have sold to Trail Duty at wholesale.
 
I thought i was going to have issues but after explaining the situation to the bank the guy made it seem like this isn't uncommon and approved the dispute...of course i still have to wait for it to be refunded which could take weeks. I've been working with a Leslie at Gobi and she has been pretty helpful.
Supposed to hear from the freight company today to schedule delivery...fingers crossed!
 
I ordered a Gobi rack through Trail Duty on Black Friday. The only responses I got from Gobi where I asked. There customer service is ridiculous. In Feb they say definitely by March. Yesterday I get an email that the owner of Trail Duty has passed away and they will not fulfill my order. WHAT? I am informed to call my credit card company and stop payment. Then back to Gobi to reorder. So I contact credit card and have them stop payment. Try and contact Gobi and get. I response as expected. I go look for another company and find that LOD has a real nice rack that slides back so you don’t have to take off load to lower softtop. Just before I pull the trigger I get a call from a delivery company that has a heavy auto rack to deliver. WHAT? Sure enough the package is from Denver, has to be Gobi...customer service that does not want to be bothered and does not have a clue what is going on in there company. I really hope everything is there and in working order as I do not want to have to contact them.. ridiculous.
Chase credit easily credited me my money. Of course now I should send it back.... I would recommend some other rack company.... any other

I just got the same email. I am hoping my credit card will give me my money back. what a hassle.
